Cereal Malt Beverage
Cereal Malt Beverage shall include any fermented but undistilled liquor brewed or made from malt, malt substitute, or from a mixture of malt or malt substitute, but does not include any such liquor which is more than 3.2% alcohol by weight. Any person desiring a license shall make application to the City Clerk. The City Clerk shall issue to qualified applicants licenses for a limited retailer or club retailer, and may issue a general retailer license for taverns. All licenses shall expire at 12 midnight on December 31 following issuance; and the full amount of the license fee shall be paid regardless of the time of year in which the license is issued; provided, however, that a club retailer license will expire at the same time of his state license. No part of any license fee paid for any license shall be refunded or rebated for any reason.
Class A & B Clubs
It shall be unlawful for any person granted a Private Club (class A or B) by the State of Kansas to sell or serve any alcoholic liquor authorized by such license within the city without first obtaining a city license. All applications for new or renewal city licenses shall be submitted to the City Clerk. If the application is in proper form and accompanied by cash in the amount of the license fee, the City Clerk of the city shall, if the applicant is qualified by law (has a state license) and if there are no conflicts with any zoning, building, alcoholic beverage or other ordinances of the city, issue a city license for the period covered by the state license. The license period shall extend for the period covered by the state license. The full amount of the fee shall be paid regardless of the time of year in which the license is issued and no license fee shall be refunded for any reason.
Drinking Establishment License

All applications for new or renewal drinking establishment licenses shall be submitted to the City Clerk. If the application is in proper form and accompanied by cash in the amount of the license fee, the City Clerk, if the applicant is qualified by law (has obtained a state license) and if there are no conflicts with any zoning, building, alcoholic beverage or other ordinances of the city, issue a city license for the period covered by the state license. The full amount of the license fee shall be paid regardless of the time of year in which the license is issued and no license fee shall be refunded for any reason.
Retail Liquor
Alcoholic Retailer License Application (PDF)
Each place of business selling at retail, alcoholic liquors (including beer containing more than 3.2% of alcohol by weight) for consumption off the premises (sales in the original package only) shall pay an annual occupation or license tax in advance to the City Clerk. The license year for said retailer shall commence on the date that said retailer's license is issued by the director of alcoholic beverage control of the state department of revenue and shall end one (2) years after that date.
Taxi or Limousine Driver

Shall mean any person licensed to drive a taxicab.
Taxi or Limousine Station
Taxi and Limousine Station License Application (PDF)
Shall mean an office within the commercial zone of the city maintained as a headquarters from which one or more taxicabs operate both day and night and having a telephone and an attendant continuously on duty to answer the telephone, receive and communicate calls for taxicab service and keep records pertaining thereto.
Any person desiring a license for taxi service shall make application in writing to the City Clerk and accompany the application with the required fee for each station, vehicle and driver. All licenses shall expire on December 31 following their issuance.
Taxi
Shall mean any vehicle used for the carriage of persons for hire within the city and not operated over fixed routes and scheduled time. Each taxi is hereby declared to be a common carrier of persons.
Limousine Service
A public passenger motor vehicle with driver furnished, for hire for exclusive use at scheduled times at a charge fixed in advance.
Vehicular Vendor Firm & Vehicle
Vehicular Vendors License Application (PDF)
Includes all persons engaged in the business of selling food products from a vehicle, self-powered or otherwise on the public and private streets and sidewalks of the City of Emporia. Vehicular Vendor shall not include salesmen who use vehicles to go from place to place for the purpose of making sales on the premises of a prospective purchaser.
Pawnbroker

Means any person who loans money on deposit or pledge of personal property or other valuable thing, other than intangible personal property, or who deals in the purchase of personal property on the condition of selling the same back again at a stipulated price.
Precious Metals Dealer
Precious Metal Dealers License Application (PDF)
Means gold, silver or platinum group metals or any used articles or other used personal property containing such metals, but shall not include coins purchased for their numismatic value rather than their metal content or ingots or other industrial residue or by products composed of such metals purchased from manufacturing firms. Precious Metal Dealer means any person who engages in the business of purchasing precious metal for the purpose of reselling such metal in any form
Temporary Cereal Malt Beverage
Temporary Cereal Malt Beverage License Application (PDF)
Application shall be made to the City Clerk. All such temporary licenses shall be valid for a period of eighteen hours as specified in the license and at the place specified in the application. No more than one temporary cereal malt beverage license shall be issued to any person during any calendar year.
Caterer License
Caterer License Application (PDF)
It shall be unlawful for any person granted a caterer license by the State of Kansas to sell or serve any alcoholic liquor authorized by such license within the city without first obtaining a city license. No caterer licensed shall allow the serving, mixing, or consumption of alcoholic liquor between the hours of 2 am and 6 am on any day. Prior to any event in which a caterer will sell or serve alcoholic liquor by the individual drink, the caterer shall provide written notice to the Chief of Police at least forty-eight (48) hours prior to the event, if the event will take place within the city. The notice shall contain the location, name of the group sponsoring the event, and the exact date and time the caterer will be servicing. The license period shall extend for the period covered by the state license.
Temporary Alcoholic Liquor License

It shall be unlawful for any person granted a temporary permit by the State of Kansas to sell or serve any alcoholic liquor within the city without first obtaining a local, temporary permit from the City Clerk. The permit period shall extend for the period covered by the state temporary permit. No city temporary permit fee shall be refunded for any reason.

All provisions of Ordinance Number 22-48 shall be observed for the keeping of animal or fowl pens and keeping domestic animals (farm and nonfarm) to quality for a permit. Permit valid from January 1 to December 31 of current year.
